Privacy Notice – Allianz Trade pay

Allianz Trade is the trademark used to designate a range of services provided by Euler Hermes group (referred to below as Euler Hermes).

Euler Hermes, member of the Allianz group, is the global leader in trade credit insurance and a recognized specialist in the areas of surety, collections, structured trade credit and political risk. Euler Hermes is present in more than 50 countries with 5,800 employees.

This privacy notice explains how and what type of personal data will be collected, why it is collected and to whom it is shared or disclosed. Please read this notice carefully. 

A data controller is the individual or legal person who controls and is responsible to keep and use personal data in paper or electronic files.

Euler Hermes Services SAS, whose registered offices are at 1 place des Saisons – 92048 Paris – La Défense (France), is the data controller as defined by relevant data protection laws and regulations. 

We process the following data sent by the platform on which you are making a purchase:

Mostly commercial entities, but the identity of some businesses is tied up with that of their owner, such as sole traders, partnerships or one-person limited liability companies:

  • Your company identification number.

We will use Allianz Trade services to assess your financial solidity.

  • family name
  • business email address
  • business telephone number.

Wherever possible these data are generic company data rather than personal data (for example, if available we will use info@company.com rather than john.doe@company.com).

According to the verification methods listed below, in addition to businesses and contact data, we process the following data:

  • If you use the secure banking login option, we will store the date at which you connected to your bank account and the last transaction date with your bank account at the time. For this service, we are using the Open Banking intermediary Saltedge, which will process your data as a data controller.

  • If you use the Identity verification option, we will store the date of successful Identity verification executed by the Online Identity Verification Platform Onfido, acting as a data processor. Onfido will store your identity card details after the check. Only in case of a claim, will we require access to that information.

  • If you use the Wire transfer option, we will use the date at which we got the approval from Fintecture as part of the Customer Verification process executed by Fintecture as a data controller.

We use a fraud detection provider, Forter.

For the purpose of fraud detection, the following personal data categories may be processed:

  • Personal information and contact details (e.g., name, email address, address)
  • Account and limited financial information (e.g., basic information regarding payment and billing method and partial credit card details)
  • Transaction information (e.g., information about a transaction completed on one of our customer’s websites)
  • Location information
  • Device, connection and browser information (e.g. IP address, device unique identifiers, etc.)

We will collect and process your personal data on the basis of our legitimate interest to:

  • confirm your business identity;
  • verify that you are eligible for payment on account,
  • detect and prevent fraud,
  • provide credit risk information;
  • underwrite credit risks for our policy holders;
  • collect debts for ourselves and for our customers;
  • meet our legal obligations.

We also store those data in order to be able to provide the deferred payment service to you with multiple sellers and avoid that you have to do strong verification checks again.  

We will ensure that your personal data is processed in a manner that is compatible with the purposes indicated above.

For the stated purposes, we may share your personal data with the following parties who operate as data processors under our instruction:

  • Other Allianz Group companies, technical consultants, experts, lawyers, loss adjustors, repairers, medical doctors; and service companies to discharge operations (claims, IT, postal, document management); and
  • Advertisers and advertising networks to send you marketing communications, as permitted under local law and in accordance with your communication preferences. We do not share your personal data with non-affiliated third parties for their own marketing use without your permission.
  • Fraud detection providers
  • Strong verification check providers

Finally, we may share your personal data in the following instances:

  • In the event of any contemplated or actual reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in any insolvency or similar proceedings; and to meet any legal obligation, including to the relevant ombudsman if you make a complaint about the product or service we have provided to you. 
If you are a resident of the European Economic Area (EEA), the United Kingdom (UK) or Switzerland, your personal data will be processed in the EEA and UK by the parties specified in section 4 above, subject always to contractual restrictions regarding confidentiality and security, in line with applicable data protection laws and regulations. We will not disclose your personal data to parties who are not authorized to process them. 

Where permitted by applicable law or regulation, you have the right to:

  • Access your personal data held about you and to learn the origin of the data, the purposes and ends of the processing, the details of the data controller(s), the data processor(s) and the parties to whom the data may be disclosed;
  • Withdraw your consent at any time where your personal data is processed with your consent;
  • Update or correct your personal data so that it is always accurate;
  • Delete your personal data from our records if it is no longer needed for the purposes indicated above;
  • Restrict the processing of your personal data in certain circumstances, for example where you have contested the accuracy of your personal data, for the period enabling us to verify its accuracy;
  • Obtain your personal data in an electronic format for you or for your new insurer; and
  • File a complaint with us and/or the relevant data protection authority.

The terms of these privacy notices are subjected to any additional terms, disclaimers or other contractual terms you have entered into with Euler Hermes such as client privacy statements or notices, as well as any applicable mandatory laws and regulations.

As a member of the Allianz group, Euler Hermes is bound by Allianz’ Binding Corporate Rules (BCRs).  These rules govern the international transfer of personal data between Allianz group companies operating in the European Economic Area (EEA) and Allianz group companies outside that area, and describe your rights in respect of such transfers, what to do if you want to exercise your rights or complain about such transfers, and how to contact us. You may exercise these rights by contacting us as detailed in section 9 below providing your name, email address, account identification, and purpose of your request. 

Where permitted by applicable law or regulation, you have the right to object to us processing your personal data, or tell us to stop processing it (including for purposes of direct marketing). Once you have informed us of this request, we shall no longer process your personal data unless permitted by applicable laws and regulations.

You may exercise this right in the same manner as for your other rights indicated in section 6 above. 

We will not retain your personal data for longer than necessary and we will hold it only for the purposes for which it was obtained.
