To increase the level of data protection and in compliance with the applicable laws and regulations, we have implemented the add-on programs via a “two-click solution”. This procedure ensures that no direct connection is established between your browser and the operator’s servers when you visit the Euler Hermes website. Only when you activate the plug-ins by clicking on them and thus give your consent to the data processing does your browser establish a direct connection with the relevant operator’s server. 6.1 Federal Act on Data Protection, FADP – rights 

You have the right to the extent permitted by the applicable laws or regulations:

Deletion of information

Under the rights provided by the CCPA, you may also request that your data be deleted. The right to deletion does not apply if the retention of personal data is necessary to achieve one of the following objectives:

  • To conduct research in the public interest
  • To safeguard the right to freedom of expression

Sale of personal data

We process your personal data on the basis of the need to prepare and/or perform a contract with you and on the basis of our legitimate business interests for the above purposes, including the performance of a contract with the company you work for or represent.

This personal data is provided to us by you, your employer, the company you represent, or by third parties.

You must ensure that the personal data you provide to Euler Hermes is reliable, accurate, complete and up-to-date. If this personal data needs to be updated, changed or deleted, you undertake to inform Euler Hermes immediately in writing.

2.5 Retention period

We store this personal data for as long as it is relevant to the contractual relationship and necessary to fulfil the purposes for which it was collected or to comply with our legal obligations, or as permitted by law to protect our legitimate business and legal interests, e.g. to defend ourselves against legal claims. After that, we will delete your personal data.

 

3. Profiling 

Article 5 (f) FADP defines “profiling” as any form of automated processing of personal data which involves using such data to evaluate certain personal aspects relating to an individual, in particular to analyse or predict aspects relating to that individual’s work performance, economic situation, health, personal preferences, interests, reliability, behaviour, residence or change of location.

Euler Hermes does not engage in profiling in the sense of Article 5 (f) FADP.

Access to certain information and right to data portability

You have the right to request that Euler Hermes disclose to you certain information about the collection and use of your personal data over the past 12 months. Once we have received and confirmed your verifiable request, we will provide you with the following information in a portable format:

  • The categories of personal data we have collected about you
  • The categories of sources for the personal information we have collected about you
  • Our business or commercial purposes for collecting or selling this personal data
  • The categories of third parties whom we share this personal data with
  • The specific personal data we have collected about you

Deletion of information

Under the rights provided by the CCPA, you may also request that your data be deleted. The right to deletion does not apply if the retention of personal data is necessary to achieve one of the following objectives:

  • To provide goods or services to you
  • To identify or correct safety or function-related problems
  • To comply with the law
  • To conduct research in the public interest
  • To safeguard the right to freedom of expression
  • To carry out all measures for internal purposes that you can reasonably expect

Non-discrimination

Euler Hermes will not discriminate against you for exercising your rights under the CCPA. Unless permitted by the CCPA, we will not:

7.1 Which security measures have been taken to protect information?

We have implemented appropriate technical and organisational security measures to protect your personal data from unauthorised access, misuse, loss or destruction.

7.2 How do we handle electronic messages sent to and from Euler Hermes?

All electronic messages sent to and from Euler Hermes are protected by appropriate technical and organisational measures and may only be disclosed to certain persons in defined functions (e.g. Legal, Compliance, Risk) in justified cases in accordance with the applicable laws and regulations (e.g. court order, suspicion of criminal acts, breach of regulatory obligations). All e-mails are deleted after the expiry of the applicable retention period.

7.3 What should you bear in mind when sending data over the Internet?

The Internet is not generally considered to be a secure environment, and information sent over the Internet (e.g. to or from the Euler Hermes website or by electronic message) may be viewed by unauthorised third parties, which may result in disclosure, changes in content or technical malfunctions. Even if the sender and the recipient are in the same country, information sent over the Internet can still be forwarded across international borders to a country with a lower level of data protection than in your country of residence.

We process personal data about the (potential) customers of our customers (“Buyers”):

  • To confirm the identity of your company 
  • To help with risk assessments of the company with regard to business, financial and compliance operations

  • To assume credit risks for our policyholders
  • To issue bonds
  • To assess and monitor our own risk
  • To collect receivables for ourselves and our customers

2.2 Legal basis

This processing is based on the legitimate interests of Euler Hermes and, where applicable, other Allianz Group companies and our customers in pursuing the above purposes, provided that the processing is necessary for these purposes. 

Before we process personal data, we balance these legitimate interests against the potential impact on the interests, rights and freedoms of the data subjects. 

We take care to exclude special categories of personal data from this processing and take the legitimate expectations of the data subjects into consideration. 

2.3 Categories of personal data

We process the following categories of personal data about business owners, directors and representatives:

Companies (mostly commercial companies, but the identity of some companies is linked to that of their owner, e.g. sole traders, partnerships or single-member limited liability companies):

  • Company name (which may be a personal name) and legal form
  • Company activity, sector and size
  • The companies’ credit rating
  • Contact details such as the company’s postal address, e-mail address, telephone number and fax number. Wherever possible, this data is general company data and not personal data (e.g. where available, we will use info@company.com rather than john.doe@company.com)
  • VAT identification number and other company identification numbers (from authorities, chambers of commerce, Euler Hermes and/or data brokers)
  • Financial information about the company, e.g. bank details, bank account, financial status, assets and net assets
  • Company payment history and patterns, profitability and other information on creditworthiness (e.g. payment and risk events), including the insolvency situation

Owners, directors and representatives of companies:

  • First name, surname, gender, title, job title
  • Affiliation with different companies (past and present)
  • Information for shareholders

2.4 Information sources

We collect the aforementioned personal data in accordance with all applicable regulations from: 

  • You yourself
  • Your website or other publications that you make available to the public
  • Companies you work for or represent 
  • Our customers
  • Our business partners
  • Service providers working to combat abuse (which maintain databases with identification numbers of end devices) 
  • Providers of identity verification services 
  • Direct marketing companies 
  • Publicly available information, e.g. commercial registers, public statistical databases and websites 

If we collect your personal data directly from you, you are not required to provide us with the personal information we request. However, in some cases, this may affect the extent to which we can provide trade facilitation services to you and your business partners. 

2.5 Retention period

We will retain your personal data only for as long as is necessary to achieve the above purposes, in accordance with our information and document management standard. 

We will retain your personal data for as long as we are legally obliged to retain it or for as long as we require it to defend ourselves against possible legal claims.

Payment history data is deleted when it is no longer relevant to your company’s creditworthiness.

It is in Euler Hermes’ interest to use only relevant, accurate and up-to-date information. All the data we process is constantly updated and verified. 

 

3. Profiling 

Article 5 (f) FADP defines “profiling” as any form of automated processing of personal data which involves using such data to evaluate certain personal aspects relating to an individual, in particular to analyse or predict aspects relating to that individual’s work performance, economic situation, health, personal preferences, interests, reliability, behaviour, residence or change of location.

Euler Hermes does not engage in profiling in the sense of Article 5 (f) FADP. 

 

4. Who has access to your personal data?

We will ensure that your personal data is processed in a manner consistent with the purposes described above. 

For the above purposes, your personal data may be disclosed to the following parties, who are responsible for data processing as third parties:

  • Other Allianz Group companies
  • Authorised representatives, brokers and third-party service providers
  • Our customers, if you are their customer or potential customer

For the above purposes, we may also disclose your personal data to the following parties, who act as data processors on our behalf:

  • Authorised representatives, service providers who facilitate and/or provide portions of our services, and research analysis agencies
  • Hosts, consultants and experts who manage Euler Hermes’ communications and events it sponsors
